Mobile ECU Remapping & Tuning Services – England & Wales

1. Definitions and Interpretation

1.1 In these Terms and Conditions:

“Business” means any trade, profession, or commercial activity;
“Consumer” has the meaning given under the Consumer Rights Act 2015;
“Customer / You / Your” means the individual requesting the Service(s);
“Garage / We / Us / Our” means CAT KUSTOMS (trading as Cátia Farias);
“Service(s)” means ECU remapping, tuning, software modification, diagnostics, and related digital services;
“Vehicle” means any vehicle presented for remapping or tuning services;
“Work” means the agreed Service(s) to be carried out.

1.2 These Terms apply to all Services provided by CAT KUSTOMS.

2. Service Scope

2.1 CAT KUSTOMS provides mobile ECU remapping and tuning services only.
2.2 No mechanical repairs, parts supply, or physical vehicle servicing are provided.
2.3 Our service is limited to software modification and calibration only.

3. Booking and Acceptance

3.1 Bookings may be made via phone, email, or messaging platforms (including WhatsApp and social media).
3.2 You must provide accurate vehicle and personal details when booking.
3.3 A booking is only confirmed once accepted by Us.
3.4 By confirming a booking, You agree to these Terms and Conditions in full.

4. Payments

4.1 Payment is due immediately upon completion of the Service unless otherwise agreed.
4.2 Accepted payment methods include bank transfer and other agreed methods.
4.3 Work may not commence without prior agreement or deposit where required.

5. Customer Responsibility

5.1 You accept full responsibility for:

The condition of the Vehicle prior to tuning
Any risks associated with modifying the ECU software
Ensuring the Vehicle is mechanically sound before remapping

5.2 A full diagnostic check is strongly recommended prior to any tuning.
5.3 You must follow any instructions or aftercare guidance provided.

6. Legal Compliance and Use

6.1 You are solely responsible for ensuring that any modifications comply with local laws and regulations.
6.2 CAT KUSTOMS accepts no responsibility for illegal use of modified software.
6.3 The use of tuned vehicles on public roads must comply with UK and EU regulations.

7. Emissions and Road Use

7.1 CAT KUSTOMS will not be held liable for any software that alters, disables, or bypasses emission control systems.
7.2 It is Your responsibility to ensure the Vehicle complies with applicable Euro Emission Standards.
7.3 Any off-road or motorsport use is entirely at Your own risk.

8. Liability Disclaimer

8.1 All tuning and remapping services are performed at the Customer’s own risk.
8.2 We are not liable for:

Engine, gearbox, turbo, or component failure
Pre-existing faults or hidden defects
Loss of performance due to mechanical condition

8.3 We are not responsible for any indirect losses including:

Loss of income
Loss of business
Vehicle downtime

8.4 Nothing in these Terms excludes liability for death or personal injury caused by negligence.

9. Warranty Disclaimer

9.1 No mechanical warranty is provided with any remapping or tuning service.

9.2 Software is supplied as-is, unless otherwise explicitly agreed in writing.

9.3 No guarantees are provided regarding performance gains, fuel efficiency, or compatibility with future mechanical modifications or third-party software.

9.4 CAT KUSTOMS offers one complimentary diagnostic check and/or software retweak within 48 hours of the original remap or tuning service, provided the Vehicle remains in the same condition as at the time the Service was completed.

9.5 Any requests for diagnostics, revisions, retuning, software adjustments, or retweaks after the 48-hour period shall be chargeable at the current applicable rate.

9.6 CAT KUSTOMS reserves the right to refuse any retuning, revision, diagnostic inspection, or software adjustment where:

The Vehicle has been modified after the original Service;
A third-party tuner, garage, technician, or Business has inspected, accessed, verified, altered, read, written, copied, or modified the ECU software or calibration data;
Mechanical faults or unrelated issues are present which may affect the tuning results or reliability.

9.7 Where the Customer allows any third-party tuner, garage, technician, or Business to inspect, verify, test, alter, or access the ECU software after the Service has been completed, the Customer automatically waives any entitlement to complimentary retweaks, software revisions, or warranty-related claims relating to the tuning software supplied by CAT KUSTOMS.

9.8 All tuning and remapping services remain subject to the Vehicle’s mechanical condition, maintenance history, and correct operation at the time of and after the Service.

9.9 Features such as Pops and Bangs, Crackles, Burbles, Hard Cut Limiters, Launch Control, Flame Maps, and other performance-based software modifications are supplied strictly at the Customer’s own risk.

9.10 The Customer understands and accepts that these modifications may place additional stress on the engine, turbocharger, exhaust system, fuel system, injectors, pistons, piston rings, piston lands, catalytic converters, DPF systems, and other related mechanical or electronic components.

9.11 CAT KUSTOMS accepts no liability whatsoever for any wear, damage, failure, or reduced lifespan of components arising from the use of such performance features, whether immediate or over time.

9.12 By requesting these modifications, the Customer confirms that they fully understand and accept the potential risks associated with aggressive tuning features and accepts full responsibility for any resulting mechanical or electrical issues.

10. Tools and Equipment

10.1 We use professional tools and software; however:
10.2 We are not responsible for ECU failure, corruption, or communication issues.
10.3 Recovery of ECUs, where required, may incur additional charges.

10.4 Trade-to-Trade and Third-Party ECU Handling

Where an ECU is removed, supplied, fitted, or handled by a third-party garage, workshop, trader, technician, or other Business acting on behalf of the Customer, CAT KUSTOMS accepts responsibility solely for the tuning software, calibration data, and digital file(s) supplied.

10.5 CAT KUSTOMS accepts no liability whatsoever for:

- ECU removal or refitting procedures

- Electrical or hardware damage

- Voltage spikes or power surges

- Damage caused by failure to disconnect the vehicle battery prior to ECU removal

- Damage to vehicle modules, wiring, immobiliser systems, or electronic components

- Incorrect installation, handling, or transportation of the ECU

10.6 It is the sole responsibility of the third-party garage, trader, technician, or Business carrying out the ECU removal/refitting to ensure correct procedures are followed, including battery disconnection and safe handling procedures prior to any Work being undertaken.

10.7 Where AdBlue, DPF, or related emissions systems require resets, adaptations, or fault rectification, these must be completed prior to ECU removal and/or software installation. CAT KUSTOMS accepts no responsibility for issues arising from incomplete, incorrect, or omitted resets or adaptations.

10.8 Any trade customer, garage, workshop, or third party supplying ECUs to CAT KUSTOMS for tuning services does so entirely at their own risk and accepts full responsibility for the hardware and vehicle condition before and after the Service is provided.

11. Cancellations

11.1 You may cancel a booking with reasonable notice.
11.2 Deposits for custom tuning work may be non-refundable.
11.3 If Work has already commenced, You will be charged accordingly.

12. Data Protection

12.1 We process personal data in accordance with the Data Protection Act 2018.
12.2 Your data is used only for:

Providing services
Processing payments
Customer communication

12.3 We do not share your data with third parties without consent.

13. Consumer Rights

13.1 Nothing in these Terms affects your statutory rights under:

Consumer Rights Act 2015
Consumer Contracts Regulations 2013

14. Governing Law

14.1 These Terms are governed by the laws of England & Wales.
14.2 Any disputes shall be subject to UK jurisdiction.

By booking or using our services, you confirm that you have read, understood, and agreed to these Terms and Conditions.
